Terms of sale
These terms of sale are entered into by SURLUXE, registered with the Nanterre Trade and Companies Register under number 811479575,
and, on the other hand, by any individual or legal entity wishing to make a purchase through the website www.mdcibeaute.com operated by SURLUXE, hereinafter referred to as the "BUYER".
Purpose
These provisions are established to govern the terms of sale between SURLUXE and purchases made through this website.
Placing an order constitutes acceptance of these General Terms and Conditions of Sale, which SURLUXE reserves the right to modify at any time.
Prices
SURLUXE reserves the right to modify the prices listed on www.mdcibeaute.com.
Orders:
Placing an order constitutes acceptance of these General Terms and Conditions of Sale.
Orders are processed at the price listed on www.mdcibeaute.com at the time of the order, subject to availability.
Orders and payment are processed securely through Shopify.
Right of Withdrawal:
The buyer has a fourteen-day withdrawal period beginning on the date their order is delivered.
In the event of a request for exchange or refund, the returned product(s) must be sent at the buyer's expense (pursuant to Article L. 121-20) to SURLUXE at the following address: 3 Allée des Lilas, 92150 Suresnes, France.
Exchange or refund will only be possible for unused products in perfect condition, in their original packaging, unopened, with the cellophane seal intact.
Payment:
An order is considered accepted only upon full payment of the agreed price.
Payments are processed securely through Shopify.
Delivery
Deliveries are made to the address provided by the buyer.
Risk transfers to the buyer once the products leave SURLUXE's premises. Delivery is entrusted to third-party carriers such as DHL or La Poste.
In the event of damage during transit, the buyer is responsible for refusing delivery of any visibly damaged parcel upon receipt.
Orders returned to us because they were not collected by the customer due to unpaid customs fees or any other reason will be partially refunded, with deduction of shipping and return costs equal to twice the initial shipping cost, plus a flat fee of €20.
Delivery Delays and Claims
SURLUXE cannot be held responsible for delivery delays.
A delivery delay does not justify cancellation of the order.
In the event of a lost parcel or receipt of a damaged product, SURLUXE may file a claim with the carrier but is not responsible for the speed or outcome of their response.
Issues arising during the delivery of an order are beyond the control of SURLUXE, which must await the outcome of such claims before proceeding with any exchange or replacement.
Disputes:
These terms of sale are governed by French law. Any disputes arising from their interpretation or performance shall fall under the exclusive jurisdiction of the Nanterre courts. The reference language for any dispute resolution is French.
Personal Data
In accordance with the French Data Protection Act of 6 January 1978, buyers have the right to access and correct their personal data.
They may also, by notifying SURLUXE, refuse the disclosure of their contact details.
SURLUXE reserves the right to collect information about buyers.
Dispute Resolution
These online terms of sale are governed by French law. In the event of a dispute, jurisdiction is attributed to the competent courts.
